Terms of Service (“Terms”) govern your access to and use of My Storm Alert.

Welcome to My Storm Alert. The My Storm Alert website, services, and applications (collectively, the “Service”). By subscribing or accessing the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By clicking “I Agree,” subscribing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

My Storm Alert provides personalized severe weather monitoring and notification services for the exact physical address you register. Alerts may be delivered via text message, email, or phone call, depending on your subscription tier.

All alerts and communications originate from My Storm Alert. While our phone call alerts may include real-time conversations with a meteorologist when warranted, we do not accept inbound phone calls or support two-way communication via text or email. This structure allows our meteorologists to remain fully focused on evaluating hazards and delivering the highest level of service possible.

3. Subscriber Responsibilities

  • You must provide accurate, current, and complete information when registering, including a valid physical address and contact details.

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

  • You must have a means to receive official National Weather Service (NWS) warnings (e.g., NOAA Weather Radio, WEA alerts, or a local alerting app) and agree not to rely solely on My Storm Alert for emergency management or protective action decisions.

  • You acknowledge and accept the inherent uncertainty of weather forecasting and the limitations of real-time data. You understand that My Storm Alert is a supplemental source of information and does not issue official warnings, watches, or advisories.

4. Disclaimers and Service Limitations

  • No Guarantee of Notifications: While we strive for accuracy and timeliness, meteorology is an inexact science. We do not guarantee that every alert will be delivered or received without delay, interruption, or error.

  • Supplemental Source Only: My Storm Alert is not a replacement for official National Weather Service (NWS) warnings. We do not issue official tornado warnings, severe thunderstorm warnings, flash flood warnings, or any other government alerts. You are responsible for staying informed through official channels.

  • Third-Party Dependencies: Our ability to monitor and notify you depends on data and infrastructure from third parties (e.g., radar networks, mobile carriers, internet providers). We are not liable for outages, delays, or inaccuracies resulting from the failure or degradation of these external systems.

  • Official Determinations: All official tornado warnings, designations, and post-event ratings (e.g., EF-scale assessments) are issued solely by the National Weather Service. My Storm Alert does not make official determinations or official warnings.

5. Limitation of Liability

IN NO EVENT SHALL MY STORM ALERT, ITS OWNERS, AFFILIATES, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF LIFE, PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This limitation applies regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise. My Storm Alert is not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, telecommunications failures, or widespread service disruptions.

6. Subscriber Actions

Subscribers are solely responsible for any decisions or actions taken (or not taken) based on the information provided by My Storm Alert. My Storm Alert shall not be held liable for any outcomes or consequences resulting from subscriber actions or inactions.

7. Service Rights & Termination

My Storm Alert reserves the right to cancel, suspend, or discontinue service at any time and for any reason, with or without notice.

We also reserve the right to decline renewal of any subscription at our sole discretion.

You may cancel your subscription at any time through your account settings if you create an account. Otherwise, you must submit notice of requested cancellation through our unsubscribe page. Cancellations take effect at the end of the current billing cycle. Refunds are not issued unless required by law or granted at our sole discretion.

8. Indemnification

You agree to indemnify, defend, and hold harmless My Storm Alert and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service or breach of these Terms.

9. Fees and Payment

  • Subscription fees are billed in advance on a monthly or annual basis, depending on your plan.

  • All fees are non‑refundable, except as required by law or at My Storm Alert’s sole discretion.

  • My Storm Alert reserves the right to change pricing or features of any subscription tier with prior notice. Continued use of the Service after changes constitutes agreement to the new pricing.

10. Changes to Terms

My Storm Alert may modify these Terms at any time. We will notify of significant changes by email or by prominently posting a notice on our website. Changes will take effect no earlier than 14 days after such notice, unless otherwise required by law.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.

By using the Service, you agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Tennessee, and you hereby consent to the personal jurisdiction of such courts.

To the fullest extent permitted by applicable law, you waive any objection to such venue and jurisdiction, including claims of inconvenient forum.

12. Arbitration Agreement and Dispute Resolution

Mandatory Arbitration:
You and My Storm Alert agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the breach, termination, enforcement, interpretation, or validity thereof (collectively, “Disputes”), will be resolved exclusively and finally through binding arbitration, rather than in court.

Exceptions:
This agreement to arbitrate does not apply to:
(a) claims that qualify for small claims court,
(b) claims for injunctive or equitable relief related to intellectual property rights or unauthorized use of the Service.

Arbitration Rules and Forum:
The arbitration will be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA) and will take place in the State of Tennessee, unless otherwise mutually agreed.

Class Action Waiver:
You and My Storm Alert agree that any arbitration or legal proceeding shall be conducted only on an individual basis, and not as a class, collective, consolidated, or representative action.

Waiver of Jury Trial:
You and My Storm Alert waive any constitutional and statutory rights to go to court and have a trial in front of a judge or jury.

Governing Law:
This arbitration agreement shall be governed by the Federal Arbitration Act (FAA) and applicable federal arbitration law.

13. Communication and Data

By subscribing to the Service, you consent to receive service-related communications via text message, email, or phone call, based on your selected plan. Standard carrier messaging and data rates may apply.

You agree to receive recurring SMS/text messages from My Storm Alert LLC for storm monitoring notifications. Message & data rates may apply. Reply STOP to unsubscribe. Consent is not a condition of purchase. Replying STOP to unsubscribe does not deactivate your subscription.

We will not sell or share your personal information without consent, as outlined in our Privacy Policy.
